Instagram Contest - terms and conditions

These Terms and Conditions set out the rules of the contest conducted on our Instagram page. This document is required under Article 13 of the Act of May 30, 2014 on Consumer Rights (Journal of Laws 2014, item 827) and under a regulation of the Parliament.

A. Participants and Rules of the Contest

  1. Participation in the Contest is voluntary and free of charge.

  2. Any natural person (a consumer as defined in Article 22 of the Civil Code), hereinafter referred to as the Participant, who: a. has read and accepted these Terms and Conditions and consented to the processing of personal data to participate in the Contest by submitting their entry;
    b. is at least 18 years old and has full legal capacity;
    c. is at least 15 years old and has full consent from their legal guardians to participate;
    d. has a public Instagram account;
    e. completes the Contest Task.

  3. Only individuals who meet the criteria outlined in §2, sec. 2 of these Terms and Conditions can participate in the Contest.

  4. Employees of the Organizer, contractors, or subcontractors involved in organizing the Contest, as well as their immediate family members (spouse, ascendants, descendants, siblings), are excluded from participation.

  5. To participate, the Participant must perform a Contest Task during the Contest period. This involves commenting, sharing, and engaging with SKYDANCE’s Instagram content, as well as posting their own outfits featuring the brand’s clothing (hereinafter: the Contest Task).

  6. If the Contest Task includes an outfit post, it must be tagged with #wearskydance. The Participant may: a. Take a photo of the outfit; b. Record a reel showing the full outfit (any format is allowed—GRWM, haul, etc.—as long as one outfit is clearly visible); c. The outfit does not have to consist entirely of SKYDANCE pieces.

  7. Completion of the Contest Task means the Participant posts any form of creative expression on Instagram (e.g., a comment, photograph, audiovisual work) that complies with Instagram’s terms and conditions.

  8. Only Participants who complete the Contest Task during the Contest period will be considered.

  9. Participants may submit multiple entries.

  10. The Organizer reserves the right to remove and disregard Contest Tasks submitted by authors who: a. act on behalf of others;
    b. use fake accounts/profiles on Instagram;
    c. create fake accounts/profiles;
    d. violate Instagram's regulations;
    e. use offensive, pornographic, hateful, discriminatory, or personally harmful content.

B. Rights to Contest Tasks

  1. The Participant guarantees that the Contest Task does not infringe the rights or interests of the Organizer or third parties, including copyrights and personal rights.

  2. The Participant declares that they hold the exclusive and unlimited copyrights to the Contest Task and that it has not been previously published or encumbered by third-party rights.

  3. Pursuant to Article 921 §3 of the Civil Code, upon awarding the Prize, the Organizer acquires a non-exclusive license to the awarded Contest Task with no time or territorial restrictions. The Winner grants the Organizer a non-exclusive license in the following fields of exploitation: a. recording and reproducing the work—by printing, reprography, magnetic recording, or digital technique;
    b. trading in the original or copies—distribution, lending, or leasing;
    c. dissemination through public performance, exhibition, display, playback, broadcasting, re-broadcasting, and public sharing in a way that allows anyone to access it at a time and place of their choosing, including via computer and telecommunication networks.

C. Prizes and Winner Selection

  1. After the Contest ends, the Organizer will review all valid Contest Tasks and select one (1) most active Winner.

  2. The Winner may choose any clothes and accessories worth a total of 150 PLN.

  3. Prizes are exempt from personal income tax under Article 21 sec. 1 item 68 of the PIT Act.

  4. The Organizer’s panel will complete the Winner selection by the second day of the following month at the latest.

  5. Winners will be announced via a post listing Instagram profile names on @shopskydance.

  6. Winners will also be notified via private message on Instagram.

  7. To receive the Prize, the Winner must send the Organizer their full name, email address, and mailing address within 7 days of notification.

  8. Failure to provide the above data within the timeframe will result in another Participant being selected as the Winner.

  9. The Organizer is not responsible for failure to deliver the Prize due to incorrect or missing contact information.

  10. Each Prize will be sent once to a Polish address provided by the Winner within 7 days of receiving their shipping details.

  11. The Prizes are funded by the Organizer.

  12. The Winner may decline the Prize by submitting a written declaration.

  13. A Participant may win only once (or more than once, if applicable).

  14. The Prize will be shipped at the Organizer's expense.

D. Personal Data

  1. The Organizer is the administrator of the Participants' personal data. Contact is possible via the address listed above or by email: shop@skydance.pl.

  2. The legal basis for data processing is Article 6(1)(a) GDPR—Participant's consent—and Article 6(1)(f), i.e., the legitimate interest of the data controller, such as handling complaints and claims.

  3. Personal data will be processed only to carry out the Contest, identify Winners, handle claims, and deliver the Prize.

  4. Providing data is voluntary, but necessary for Prize delivery or complaint submission.

  5. Data will be stored for the duration of the Contest and up to 5 years afterward to meet legal obligations or resolve potential claims.

  6. Participants have the right to access, correct, delete, limit processing, and transfer their data.

  7. Consent may be withdrawn at any time without affecting previous lawful processing. Withdrawal must be submitted electronically to: shop@skydance.pl.

  8. Data recipients include hosting providers, postal services, accounting/tax service providers, and public authorities within legal limits.

  9. Data will not be processed automatically or used for profiling.

E. Complaints

  1. Participants may submit complaints via email (with the subject “Complaint: Activity Contest”) to shop@skydance.pl during the Contest or up to 14 days after it ends.

  2. The complaint should include the Participant’s full name and mailing address for the response.

  3. The Organizer will respond within 14 days.

  4. A negative outcome does not exclude the Participant's right to pursue legal remedies.

F. Final Provisions and Technical Information

  1. These Terms and Conditions take effect on March 1, 2023.

  2. The Contest is not a promotional lottery as defined by the Gambling Act of July 29, 1992 (Journal of Laws 2004, No. 4, item 27, as amended).

  3. The Organizer is not responsible for Participants' failure to submit Tasks due to reasons solely attributable to them.

  4. The Terms and Conditions will be available during the Contest at: https://skydance.pl/pages/contest-conditions.

  5. The Organizer will make every effort to resolve any disputes amicably.

  6. Disputes will be resolved by the competent court in accordance with applicable law.

  7. This Contest is not organized, sponsored, endorsed, or administered by Instagram.

  8. Instagram bears no responsibility for the Contest. The Organizer assumes full responsibility.

  9. Any changes to the Terms and Conditions require publication and notification to Participants. Changes may only be made to comply with applicable legal standards.
