Terms and conditions of discounts for purchases at trade fairs

A. Terms of Offer.

1. Participation in the offer is voluntary and free of charge.
2. Offer valid until 31/10/2023.
3. The offer may be participated in by a natural person (consumer within the meaning of Art. 22 of the Civil Code), hereinafter referred to as the Participant, who:
   1. has read these Regulations and accepted their content and has consented to the processing of personal data for the purpose of conducting the Competition by registering for participation in the Competition;
   2. has a public account (profile) on Instagram;
   3. complete the task assigned below.
4. Only a person who meets the conditions specified in §2. paragraph 2 of the Regulations may participate in the Competition.
5. Employees of the Organizer and entities and employees of entities providing services to the Organizer when organizing the Competition on the basis of civil law contracts, as well as members of the immediate family (spouses, ascendants, descendants and siblings) of the above-mentioned persons are excluded from participation in the offer.
6. In order to participate in the offer , during its duration, the Participant will complete a Task consisting of sharing a post or Insta Story presenting the products purchased at our stand.
7. Within a post or Insta story, you can:
   1. Take a photo showing the styling;
   2. record a video showing the entire styling (any form - grwm, haul, ootd, or other type of content);
   3. present products lying/on a hanger.
8. In both cases you must:
1. tag our Instagram account (@shopskydance);
2. inform us in a private message that the purchase was made at a fair and specify which one.
9. Completing the task means that the Participant posts any form of creative expression on Instagram, such as a photograph or an audiovisual work, that can be posted on Instagram and complies with the Instagram regulations.
10. Only Participants who complete the task during the offer period will take part in the offer.
11. Only public accounts are eligible for the offer.
12. A participant may take part in the offer once.
13. The Organizer reserves the right to remove and not include in the offer completed Contest Tasks whose authors:
    1. they do not act on their own behalf, but through third parties,
    2. operate from fictitious Instagram accounts/profiles;
    3. create fictitious Instagram accounts/profiles;
    4. Posts will be deleted immediately upon receipt of the discount code;
    5. violates Instagram's terms and conditions;
    6. used in the Contest Task words generally recognized as offensive, pornographic content, content promoting hatred on racial, ethnic or religious grounds or discriminating against social groups, violated the personal rights of third parties or entities or the Organizer.

B. Rights to completed Competition Tasks.

1. The Participant guarantees that the completed Task will not violate any rights or goods of the Organizer, third parties and entities, in particular their property and personal copyrights and personal rights.
2. The Participant declares that he/she has exclusive and unlimited copyright to the completed Task and that the completed Contest Task is not encumbered with any third party rights and the work has not been previously published.
3. Pursuant to art. 921 § 3 of the Civil Code, the Organizer reserves, upon issuing the Prize, the acquisition of a non-exclusive license to the awarded Contest Task without time and territorial limits, and the awarded Contest Participant (Winner) grants the Organizer a non-exclusive license to the awarded Contest Task in the following fields of exploitation:
   1. in the scope of recording and reproducing the work - producing copies of the work using a specific technique, including printing, reprographic, magnetic recording and digital technology;
   2. in the scope of circulation of the original or copies on which the work was fixed - introduction to circulation, lending or rental of the original or copies;
   3. with regard to disseminating the work in a manner other than that specified in point b - public performance, exhibition, display, reproduction and broadcasting and re-broadcasting, as well as making the work publicly available in such a way that everyone can have access to it at a place and time of their choosing, including entering the work into computer memory and telecommunications and IT networks.

C. Prizes and selection of Winners.

1. Each participant of the Offer, after inserting a photo and sending information about making a purchase at the fair in a private message, will receive a 10% discount on purchases in the SKYDANCE online store.
2. The discount is valid until 30.11 inclusive.
3. Discount cannot be combined with discounted products and other promotions.
4. The condition for receiving the discount is that the Participant provides information about making a purchase at the fair.
5. The Organiser shall not be liable for failure to deliver the Prize to the Participant if the impossibility of delivering the Prize resulted solely from providing incorrect data or data inconsistent with the Regulations.
6. The Winner may waive the right to the Prize awarded to him/her by submitting an appropriate written statement to the Organizer.
7. The offer allows you to receive a discount only 1 (in words: one) time/more than 1 (in words: one) time.

D. Personal Data.

1. The administrator of the personal data of the Participants is the Organizer. Contact with the organizer is possible by correspondence to the correspondence address listed at the beginning of the regulations and to the e-mail address shop@skydance.pl.
2. The basis for the processing of personal data is Article 6 paragraph 1 letter a of the GDPR, the consent of the Participants to participate in the Contest and Article 6 paragraph 1 letter f, i.e. the legitimate interest of the administrator, in particular in the scope of considering complaints and pursuing claims.
3. Participants’ personal data will be processed to the extent and for the purpose necessary to carry out the offer and in the event of issuing the Prize.
4. Providing personal data is voluntary, but is a condition for issuing discounts to Winners or submitting complaints regarding identification and address data.
5. Personal data will be stored for the duration of the offer, and after its end until the statute of limitations for any claims or the expiry of the obligation to store data resulting from legal provisions, but no longer than for 5 years from the end of the calendar year in which the Competition was conducted.
6. The Organizer implements the rights of data subjects, i.e. access to the content of their data and the right to rectify, delete, limit their processing, the right to transfer data.
7. In the event of processing personal data based on consent, the Participant has the right to withdraw consent at any time, and the withdrawal of consent does not affect the lawfulness of the processing that was carried out on the basis of consent before its withdrawal. Withdrawal of consent requires electronic notification to the e-mail address shop@skydance.pl.
8. The recipients of the data are: entities providing hosting services, postal services, entities with which the Organizer cooperates within the framework of accounting and tax services, public authorities on the basis and within the limits of the law, in particular the National Tax Administration, law enforcement authorities.
9. Personal data are not processed automatically and are not subject to profiling.

E. Complaints.

1. Participants in the offer have the right to submit a written complaint with the note "Complaint: Discount for purchases at the fair" to the e-mail address shop@skydance.pl related to the course of the offer during its duration, as well as up to 14 days after the end of the offer .
2. The letter containing the complaint should indicate the name and surname of the Participant and the correspondence address to which the response to the complaint will be sent.
3. The Organizer will provide the Participant with a response to the complaint within 14 days.
4. A negative consideration of the Participant’s complaint by the Organiser does not exclude the Participant’s right to pursue claims to which he or she is entitled under generally applicable provisions of law, including through court proceedings.

F. Final provisions and technical information.

1. The regulations enter into force on 16 September 2023.
2. The offer is not a promotional lottery within the meaning of Art. 2 sec. 1 item 9 of the Act on Games and Mutual Wagering of 29 July 1992 (Journal of Laws of 2004, No. 4, item 27, as amended) and is not subject to the rules contained in the aforementioned Act and implementing regulations to this Act.
3. The Organizer of the offer is not responsible for the inability of a potential Participant to submit the completed Competition Task due to reasons attributable solely to the Participant.
4. The Organizer undertakes to make every effort to amicably settle any disputes that may arise in connection with the conduct of the offer.
5. The court with jurisdiction to resolve disputes is the court with local and subject-matter jurisdiction in accordance with the law.
6. This offer is in no way organized, sponsored, administered or endorsed by, or associated with, Instagram.
7. The entity solely responsible for conducting the offer is the Organizer, and Participants agree to release Instagram from any liability that may arise in connection with organizing the offer.
8. Any change to the Regulations requires the publication and notification of Participants about the changes made by the Organizer. Changes may be made only for the purposes of adapting the Regulations to the standards of applicable law.
